Maine Department of Agriculture, Conservation and Forestry is responsible for permitting and inspecting home kitchen licenses grocery stores, convenience stores, markets and and pre-packaged mobile sales throughout the state with sales of pre-packaged food greater than 50%. Through an MOU with Maine DHHS, DHHS inspects theses establishments when foodservice exceeds more than 50% of the establishment sales.

Maine Department of Health and Human Services is responsible for permitting and inspecting restaurants, foodservice and mobile food facilities throughout the state. Through an MOU with ME DACF, they also inspect grocery and convenience establishments when their foodservice sales exceed 50% of total sales. Inspection authority is delegated to three local agencies within the state.
